The Office of Federal Contract Compliance Programs (OFCCP) has stated that covered federal contractors must certify, on an annul basis, that they have developed and maintained an Affirmative Action Program (AAP) for their business. This certification must be done through the OFCCP’s designated Contractor Portal which will open on March 31st. The Portal’s certification feature has been recently enhanced and contractors must now provide the start date of their AAP coverage period. Covered contractors have between March 31st – June 29, 2023 to certify their compliance.

This annual requirement applies to all covered federal contractors and subcontractors. New federal contractors have 120 days to develop their AAP and must register and certify compliance through the Contractor Portal within 90 days of developing their AAP. The OFCCP’s Contractor Portal will remain open after the June 29, 2023 deadline to accommodate new contractors.
