  • Evidence supports Walgreens in class action over meal breaks

    In a case illustrating the ongoing impact of the California Supreme Court’s Brinker decision—which held that employers don’t have to require employees to take meal and rest breaks but instead must only make them available—the California Court of Appeal recently upheld the trial court’s denial of a request for class certification. The lead plaintiff in the case, Darryl Collins, had filed a class action against Walgreens claiming it violated employees’ rights to meal breaks.

    The court of appeal relied on the three categories of evidence submitted by the plaintiffs, gave no weight to any of them, and indeed noted that some supported Walgreens’ contention that it made meal breaks available. The court also confirmed that the proper standard for meal breaks is that they be “made available” to employees and that employers need not “ensure” employees take them.
